Well since everyone has a right to receive legal council I volunteer to serve the defendant.
Might I also point out this also has to be either a Criminal Trial or a Civil Trial. If it is a Criminal Trial there is no plantiff, yet there is a prosecutor, judge and jury. In this scenario no damages may be awarded to the victim. If it is a Civil Trial then there no jury, the judge has the right to decide on his/her own and the plantiff may receive damages. A jury is not required in a Civil Trial since a jury's only purpose is to unanimously determine the defendant's guilt, which is not at question at a Civil Trial. The result of a Civil Trial also doesn't go on your criminal record.
I would suggest you classify this as a Civil Trial as then you would not need a jury and the Judge would be able to order the defendant to return the keep. In a Criminal Trial for theft, assuming the jury found the defendant guilty, the only thing the judge would be able to do is punish the defendant.
