This is not accurate, and yes I know your brother is a police officer.
This varies from state to state. In my state, water pipes, rolling papers and pipes are 100% legal. So are guns. Both however have laws governing their use and it is illegal to use water pipes, rolling papers, and pipes with any form of controlled substance. Just the same as it is legal to own a gun and shoot it all you want, but it is illegal to use it to commit a crime. Smoking paraphernalia in my state is only illegal if it is USED with a controlled substance. I could have a dump truck full of UNUSED water pipes, rolling papers, vaporizer machines, and pipes parked right in front of the police station for a year and the only thing they could cite me for is a parking violation.
