PvP/Faction Thieves Can't Go Grey??? PVP

If you catch a thief or you get the message you see "char's name" attempting to seal from....

Back in the day the thief would turn gray. Now they don't??? Its like a free pass. The thief will come out of guards...steal from you, then run back to guards and there isn't anything you can do??

PLEASE tell me this is a BUG and that it is being worked on!

I assume that there are no special cases involved (warring guilds or factions, stealing from a murderer or criminal, etc.) and you are strictly talking about an innocent (blue) character stealing from another innocent character.

If that is the case, then a player that is caught stealing from another player (“You notice <name> attempting to steal< item> from you!”) will be flagged criminal (gray) for approximately two minutes. During this time they should be freely attackable and they should not be able to use transport spells such as recall or sacred journey or use a moongate.

If this is not what you experienced can you please provide additional information about the incident?
