well i got my hubby a 100% gargoyle poisn weapon and a golem but i dont think he is gaining any skill from it his swords is 76.7 does it need to be higher

you need to be at 80 skill (weapons, tactics, whatever your training) to gain from a gm golem. You can use jewels / items to get to the 80 and it will be fine.

Actually you have to be 70.1 to gain from a golem.
Make sure you are in a guild and your golem is guarding you.
