Haphazard Scrawl:
Kal Ort Por - Recall
Haphazard Scrawl:
Evening
Elvira:
Anyway please enter and find a seat
David:
How many nights has it been?
Irvyn:
I am releived to see at least some of the jury.
Ah.. Haphazard.
Haphazard Scrawl:
I ban thee
Oops
Irvyn:
*rubs chin*
Haphazard Scrawl:
*grins*
Irvyn:
Are you feeling up to this?
*tilts head*
Haphazard Scrawl:
Meant to bow there, sir
Synapses a little short circuited
Nico Viechamalli:
*dry cough*
Your notes proved most useful sir, thank you.
*nods to Hap*
Haphazard Scrawl:
It was a stimulating evening
Flame:
*nods to Nico*
Haphazard Scrawl:
particulary trying to record the vernacular of the fisherman
ah... Calvin was his name...
Nico Viechamalli:
Yes, a brave young man.
Haphazard Scrawl:
*turns to page 345 of his notes*
Nico Viechamalli:
The citizens were badly traumatised by their experiences.
*scratches cheek delicately*
He was the only one I found who felt able to testify.
Haphazard Scrawl:
'Tis nothing compared to the fall of old Trinsic in Felucca
I was young enough to man the walls in those days
Billy:
As was I
Nico Viechamalli:
The time of Juo'nar?
Haphazard Scrawl:
yes indeed, when we fought all night and day yet the city fell in our sleep despite us not sleeping!
Nico Viechamalli:
*blinks slowly, like a lizard*
I was not present on that occasion.
But I have heard many tales.
Irvyn:
*rubs chin*
Irvyn:
I have heard my cousin Ikus speak of it many times.
I was far away from here at the time.
Irvyn:
*nods to David*
Haphazard Scrawl:
Fortunately our properties in Felucca remain in our hands and still make a welcoming home when
Trammel becomes too mundane
Irvyn:
*nods to Chaismene*
Chaismene Volte:
*smiles to Irvyn*
Haphazard Scrawl:
There's still a little adventure in these old bones - not that Indecipherable Scrawl appreciates it
Irvyn:
He is perhaps a little set in his ways.
Irvyn:
Actually I would have said that about all of you in the clerks' office.
*rubs chin pensively*
It seems I have somewhat misjudged you.
Nico Viechamalli:
*small dry smile*
Irvyn:
*glances at the Kaldorian*
Gwen Irima:
*waves at Casandra*
Haphazard Scrawl:
I think those who have lived too long in the safety of the city might have lost any sense of
adventure
Billy:
Nothing nicer than standing on the battlements of the castle fighting off the murderers!
Haphazard Scrawl:
Except the chill gets in my bones these days, Billy
Flame:
*glances at Bianca and smiles*
Nico Viechamalli:
*reads through notes again*
Haphazard Scrawl:
I was rereading a classic treatise on our city earlier,
The Hitchhikers Guide to Trinsic
and it noted, of the clerk's office, "Mostly Harmless"
Irvyn:
*rubs chin with a slightly cautious expression*
Haphazard Scrawl:
An apt conclusion
Irvyn:
Yes ... some of the publication in question is ... in question.
Billy:
Apt indeed - I remember the first fireball you taught me, singed my new whiskers!
Chaismene Volte:
*hides a smile*
Haphazard Scrawl:
Ah, your Gracem what is important is the myth that lives on long after we've departed this place,
Irvyn:
*nods to Alex, looks back to Haphazard*
Haphazard Scrawl:
to the earth or to become Liches depending on one's direction in life
*chuckles*
Alexander Wylde:
*bows head to Irvyn*
Irvyn:
Possibly so.
Personally I would hope to avoid the lich idea.
Haphazard Scrawl:
Though I've seen too many liches fried to consider it a viable career choice
Irvyn:
Indeed.
Billy:
And I've fried a good few of them of course
Nico Viechamalli:
*dry chuckle*
Haphazard Scrawl:
You have indeed, young Billy
Billy:
Young - pah! Only by your standards
Irvyn:
*nods to Katrina*
Please take your seat in the jury.
Katrina Evablade:
*smiles*
*nods*
thought i would be late
Billy:
*steps asside to make room*
Katrina Evablade:
thanks
Nico Viechamalli:
I fear we still await some of the jury members.
Gwen Irima:
Hello Miss Katrina
*smiles*
Katrina Evablade:
hello *grins*
Flame:
*glances at empty chairs*
Katrina Evablade:
i'm feeling very jury..er..ery today!
Katrina Evablade:
...
Haphazard Scrawl:
I believe we have a note from Lord Sparrow saying he would be late?
Chaismene Volte:
*looks over her shoulder*
Dorat Royal Guard Commander:
*Looks around the room*
Irvyn:
We do, but he was not on the jury.
Chaismene Volte:
*stares at Dorat*
Irvyn:
*eyes Dorat briefly*
Haphazard Scrawl:
Ah, my error, my apologies
Duncan McKinley:
*salutes his officier and whispers to give him something*
Haphazard Scrawl:
I fear I am confusing day one and day two
and the jurors and the witnesses
Nico Viechamalli:
*inclines head slightly to Taggart*
Haphazard Scrawl:
Better read from my notes not rely on my memory
Nico Viechamalli:
*places notes on stand*
Haphazard Scrawl:
*consults notes*
Irvyn:
*smiles a little*
Does anyone know where our two other jurors might be?
Gwen Irima:
*shakes her head*
Irvyn:
*nods to Nathan*
Nathan Hawke:
Apologies
Nico Viechamalli:
*glances behind him*
Flame:
*shakes head*
Dorat Royal Guard Commander:
*Shifts in his chair*
Nathan Hawke:
*settles down*
Haphazard Scrawl:
We are missing Boomboom...
*continues reading notes*
Chaismene Volte:
*raises her eyebrow*
Nico Viechamalli:
And MidNyteSun.
Haphazard Scrawl:
ah yes
Edward:
*eyes the man in the hood*
Nico Viechamalli:
*consults his own notes*
Haphazard Scrawl:
So it says here
Telcrouth:
*folds hands into sleeves*
Irvyn:
*looks to Haphazard*
Reann:
recruit go remind the hooded man to remove his hood...
Irvyn:
Do the regulations say anything about this situation?
Duncan McKinley:
*shuffles over to be better use to his officier*
Edward:
Yes sarge
Taggart:
your honour may I present some evidence I may wish to use tonight?
Elvira:
Please remove your hood, its impolite to sit indoors with your hood up
Nico Viechamalli:
*looks at the Duke*
Haphazard Scrawl:
Under section 4.67.29.54 the regulations state that
Irvyn:
One moment.
Haphazard Scrawl:
for a jury to reach a decision a majority of the original
Telcrouth:
*looks around*
Irvyn:
*looks to Haphard still*
Haphazard Scrawl:
*waits*
Chaismene Volte:
Do be seated..
Edward:
Mate , the hood
Irvyn:
Please continue, Mr Scrawl.
Telcrouth:
am I on trial ?
Haphazard Scrawl:
jurors must reach the same decision so the absence of any
Edward:
*nudges Telcrouth*
Alexander Wylde:
*glances in Edwards direction*
Haphazard Scrawl:
specific juror would not have affected the majority outcome
Edward:
You w<ill be soon if you keep that hood on
Irvyn:
*nods*
Reann:
*mutters about idiots and laws...*
Haphazard Scrawl:
That being the case,
Elvira:
We cannot have hooded figures in a Trial, you may be confused as an assain
Haphazard Scrawl:
all four jurors present must
Elvira:
and get hurt...
Reann:
its against the law here to keep that hood on...
ye can remove it or leave
Haphazard Scrawl:
agree on a verdict for it to be binding over the two absent members
Telcrouth:
very well for my own safety then
Reann:
nay make me waste time explainin so again...
Irvyn:
*rubs chin*
Elvira:
Thank you
Haphazard Scrawl:
Or three agree and one abstain
Telcrouth:
*nods*
Haphazard Scrawl:
thereby the other two could not effect a majority
Edward:
And try to remember it for next time you're in Trinsic
Irvyn:
*nods*
Very well, then we will continue.
*looks to Taggart*
Katrina Evablade:
*hops*
Duncan McKinley:
*breathes in the air of his homeland*
Nico Viechamalli:
*looks over at Taggart with polite attention*
Katrina Evablade:
ringside seat!
Haphazard Scrawl:
But were one to vote against and the other three for, or vice versa
Katrina Evablade:
*chuckles to herself*
Haphazard Scrawl:
no verdict can be reached as the missing jurors hold the balance of the decision
*rubs hands at the legal minutiae*
Apologies, your Grace, I was getting carried away
*shuts up*
Nico Viechamalli:
*thin smile at Haphazard*
Irvyn:
*nods to Haphazard*
Haphazard Scrawl:
*dips pen in ink*
Irvyn:
Thank you.
*looks back to Taggart*
Haphazard Scrawl:
*starts taking notes*
Taggart:
my I present it?
Chaismene Volte:
*looks from Taggart to Nico*
Haphazard Scrawl:
*looks relieves someone has started talking*
Chaismene Volte:
*shuffles*
Irvyn:
We are waiting for you to do so.
*takes the document*
Nico Viechamalli:
*looks at it*
*looks up from it*
Irvyn:
*slightly puzzled frown*
Nico Viechamalli:
Please explain, Mr Taggart.
Taggart:
in open court?
Chaismene Volte:
*raises an eyebrow*
Chaismene Volte:
*whispers*
Nico Viechamalli:
Of course - the jury must hear.
Irvyn:
*rubs chin*
Duncan McKinley:
*shrugs*
Taggart:
well if they hear and its disallowed
Billy:
*adjusts glasses*
Nico Viechamalli:
*passes the document to the jury*
Duncan McKinley:
*deliberations*
Taggart:
it can't be undone
Duncan McKinley:
*whispers back*
Chaismene Volte:
*looks puzzled*
Irvyn:
*faint smile*
Flame:
*looks at document*
Irvyn:
I have no objections ... and since it is my document ....
*slight shrug*
Nico Viechamalli:
As your Grace pleases.
*waits politely for Taggart*
Chaismene Volte:
*picks up a pencil from her pouch and starts sketching*
Billy:
*finishes reading*
Taggart:
well I was waiting until my line of qestioning needed some proof
so first of all I will like Dorat to take the stand
Nico Viechamalli:
*birdlike tilt of head*
Dorat Royal Guard Commander:
*Nods*
Irvyn:
*looks to Nico*
Taggart:
please state your Name and rank for the jury
Dorat Royal Guard Commander:
I am Dorat, Commander of the Royal Guard
Bladius Dart:
*Looks about*
Irvyn:
*looks slightly surprised*
Bladius Dart:
*Glances over his shoulder*
Dorat Royal Guard Commander:
*Stern and proud look*
Irvyn:
*gestures to them to take a seat*
Nico Viechamalli:
*pays attention to Dorat*
Taggart:
Did Casca bring you into the Royal Guard when he allegedly became king?
Dorat Royal Guard Commander:
No, not until later
Haphazard Scrawl:
Ahem... Mr MidNyteSun is here and should take his place in the jury, your Grace
Irvyn:
*raises eyebrow slightly at "allegedly"*
Irvyn:
Indeed, yes, please do so.
Dorat Royal Guard Commander:
Sir Hawke was first appointed Commander of the Royal Guard
MidNyteSun:
aye so sorry
Sparrow:
or Mrs even
MidNyteSun:
yes Mrs,
*smiles*
Dorat Royal Guard Commander:
I took over from him on the 1st of June
Flame:
*shuffles over*
Gwen Irima:
just dont sit on lady flame
Taggart:
but you had served in the guard before becoming commander?
MidNyteSun:
*sorry Lady Flame*
Dorat Royal Guard Commander:
*Nods proudly*
For 14 years
Haphazard Scrawl:
*mutters about the misleading qualities of Ladies in full body armour*
Flame:
*smiles to *Midnightsun
Taggart:
so you have served the Kingsom for many years
Larynda:
*Nudges Tommy and whispers*
Dorat Royal Guard Commander:
Yes
Tommy Nottinbury:
*nods*
Taggart:
and have you have been in trouble during your service?
Alexander Fraser:
*Eyes the figure next to him*
Nico Viechamalli:
*dry cough*
Dorat Royal Guard Commander:
Nay, I have an outstanding service record
Nico Viechamalli:
Your Grace, this line of questioning is going to last a very long time.
Irvyn:
*nods*
Dorat Royal Guard Commander:
I wouldn't have been Commander otherwise
Irvyn:
Yes ... perhaps you could come to the point, Taggart?
Telcrouth:
*looks over briefly*
Louisa Leveire:
*Whispers to Bladius*
Bladius Dart:
*Nods*
Irvyn:
The defendant's past actions are not in question ... only what he did against Trinsic.
Taggart:
I am trying to show that Dorat served the Kingsome for many years
Kingdom
with only its best instrests at heart
so comitting treason is something he would never do
Nico Viechamalli:
*extremely sceptical expression*
Irvyn:
*rubs chin*
Alexander Fraser:
That doesna follow!
Dorat Royal Guard Commander:
*Looks at Taggart*
Irvyn:
We will take it as read that the defendant previously had a blameless record.
This court is considering the events of the 28th of June.
Nico Viechamalli:
*nods*
Taggart:
very well
during the 28th june did you strike anyone or threaten anyone with harm that could be classed as
Assault?
Dorat Royal Guard Commander:
I was leading an army
Nico Viechamalli:
*blinks once slowly, like a lizard*
Irvyn:
*raises eyebrow*
Dorat Royal Guard Commander:
So in the heat of battle, yes I did strike several soldiers down
Taggart:
and where they defencelese?
Dorat Royal Guard Commander:
They were soliers. Well armed
Taggart:
so would you class that as Assault?
Nico Viechamalli:
*looks over to Floria and makes a tiny beckoning gesture*
Dorat Royal Guard Commander:
I would class that as the normal proceedings of a battle
Taggart:
which correct me if I am wrong your not being charged with
Dorat Royal Guard Commander:
*shrugs*
I don't think so
Nico Viechamalli:
*dry smile*
*low voice*
I am relieved to see you.
Please, take a seat whilst Dorat is questioned. I will call you immediately afterwards.
*shakes head*
Floria Tenne:
*Nods*
Nico Viechamalli:
*looks back to Taggart*
Taggart:
also on the events of the 28th
Nico Viechamalli:
Excuse me sir...another witness.
*small dry smile*
Taggart:
did you illegaly remove anyone from the City of Trinsic?
Dorat Royal Guard Commander:
I did not
Taggart:
prosecutions witness
Chaismene Volte:
*looks to Nico*
Dorat Royal Guard Commander:
*Shifts uneasily*
Nico Viechamalli:
*moves back to the podium with slow deliberation*
Before I question ex-Commander Dorat
I would like to call another witness.
Nico Viechamalli:
*looks over to Floria*
Dorat Royal Guard Commander:
*Raises a brow*
Nico Viechamalli:
In fact, two more.
I regret that they were unable to attend yesterday,
Taggart:
objection
Nico Viechamalli:
or they would have been called then.
Irvyn:
What is your objection?
Taggart:
the defence was not made aware of more witnesses
Irvyn:
Nor was the prosecution made aware of your new evidence.
*touches letter on desk*
Nico Viechamalli:
*small thin smile*
Taggart:
I summited it before the trial started
Irvyn:
On the point at which the trial commenced.
Nico Viechamalli:
And the prosecution, I may point out,
had and still has no knowledge of the 'evidence'
as such.
Irvyn:
*nods*
Larynda:
*Whispers to Tommy*
Irvyn:
The witnesses may be called.
Duncan McKinley:
*tries to hear *
Dorat Royal Guard Commander:
*Looks at Nico*
Nico Viechamalli:
*nods*
Thank you your Grace.
*looks over*
Miss Neirenn, perhaps you could step up now?
Neirenn:
*Slides the robe off muttering something*
Nico Viechamalli:
*smiles in an avuncular fashion*
Thank you my dear.
I would like you to tell the court
where you were on Sunday the 28th of June.
Neirenn:
I was here in Trinsic...
Nico Viechamalli:
*nods*
And what were you doing?
Neirenn:
i was intending to report on what i had learnt to my employer... but i picked the wrong day
Nico Viechamalli:
Hmm... why was it the wrong day?
Neirenn:
she was busy making preperations for some battle... so i was trapped...
Nico Viechamalli:
I see.
So, were you mixed up in this battle?
Neirenn:
nay i tend to be good at avoiding peoples eyes... so i had no trouble avoiding things
Nico Viechamalli:
How fortunate for you.
*dry chuckle*
Did you see anything of it?
Neirenn:
aye i did
Irvyn:
*lights a lantern thoughtfully*
Nico Viechamalli:
What did you see?
Neirenn:
i decided to stick near where the civilians were... but even that nay ended up being safe
Nico Viechamalli:
Oh? Why was that?
Neirenn:
where i was stood allmost got me crushed by one of those balrons...
Nico Viechamalli:
*nods encouragingly*
Neirenn:
after that it proceded to break a door down... as you would expect of a demon no use of a handle
Alexander Fraser:
*Looks right, surprised*
Larynda:
*Arches a brow at Floria*
Bladius Dart:
*Shakes his head*
Floria Tenne:
*Goes red in the face*
Neirenn:
nay quite sure what it did in there but it came back out with a bit of a red stain...
Nico Viechamalli:
Lucky that you avoided it.
Taggart:
objection relevance
Neirenn:
following that led me to a group of people that were being herded like cattle
Nico Viechamalli:
*glances across*
Neirenn:
*looks behind her*
Nico Viechamalli:
*looks back to Neirenn*
Neirenn:
*looks back at nico*
Nico Viechamalli:
Where were they going?
Neirenn:
since fighting is nay my thing i just observed things
Nico Viechamalli:
*nods*
Neirenn:
they were led to a male in that ugly and heavy armour your fighters use... plate something
Nico Viechamalli:
*nods again*
Platemail.
Neirenn:
he told them to take them somewhere... i was keeping a fair distance but they were lead into a
portal
Nico Viechamalli:
Interesting.
Neirenn:
after that i decided to nay follow... they tend to make it hard to keep from being seen...
Nico Viechamalli:
And do you recognise anyone in the courtroom today?
Neirenn:
*looks around..*
hmm that one there...
Dorat Royal Guard Commander:
*Looks at Neirenn*
Nico Viechamalli:
In the chair?
Neirenn:
he's the one who was in the ugly plate...
Flame:
*looks at Dorat*
Gwen Irima:
still is...
Nico Viechamalli:
*dry smile*
Dorat Royal Guard Commander:
*Frowns*
Nico Viechamalli:
I call the court's attention to the fact that
Miss Neirenn has identified Dorat
as the person ordering the taking away of citizens.
Haphazard Scrawl:
*notes this in the record*
Nico Viechamalli:
Rather than leading the army.
*soft smile*
Your witness, Mr Taggart.
Larynda:
*Nods lots*
Taggart:
Miss Neirenn
Floria Tenne:
*Whispers to Duncan*
Tommy Nottinbury:
*glances at Dorat*
Neirenn:
aye?
Taggart:
would you consider your employment as above board as in legal?
Irvyn:
Objection.
*faint smile*
Nico Viechamalli:
*glances surprised at the Duke*
Neirenn:
*looks at the duke*
Alyona Karalova:
*Whispers to Iljian*
Larynda:
*Chuckles softly*
Neirenn:
*looks back to taggart*
Irvyn:
The witness has made a statement about what she saw, not what she does.
Nico Viechamalli:
*scratches cheek*
Taggart:
its relvent as it can call in question her charcter
Floria Tenne:
*Raises an eyebrow*
Nico Viechamalli:
It is a legitimate line of questioning, your Grace.
Alexander Fraser:
Pity...
Nico Viechamalli:
Provided it does not last too long.
*thin smile at Taggart*
Neirenn:
i follow a towns laws when im present in one... but aye im aware its nay a well liked job...
Alyona Karalova:
*Leans in*
Irvyn:
*scribbles in notebook*
Van Cocidius:
Urh?
Taggart:
how long did you watch the defendant for
Alyona Karalova:
*Whispers*
Van Cocidius:
*Shrugs, obviously lost interest a while ago..*
Alyona Karalova:
*frowns*
Neirenn:
nay that long... but i made a sketch of his face since he looked important givin orders
Van Cocidius:
*Shrugs*
Taggart:
long enough for a good look?
Neirenn:
aye long enough to sketch every line on his face
Hebrind Kelter:
*clears throat*
Irvyn:
*slight sigh*
Hebrind Kelter:
Excuse my lateness, your honour, and ladies and gentlemen ofthe court.
Taggart:
well he did admit he was there anyway
Irvyn:
You are excused, but Taggart has things well in hand. Please take a seat.
Taggart:
no more questions
Nico Viechamalli:
Thank you Miss Neirenn.
Chaismene Volte:
*looks over her shoulder*
Nico Viechamalli:
I now ask Miss Floria Tenne, of Yew, to take the stand.
Floria Tenne:
*Adjusts her bandana*
Nico Viechamalli:
Thank you Miss Floria.
Chaismene Volte:
*wraps her hands around her purse tightly*
Floria Tenne:
*Nods politely*
Nico Viechamalli:
Please could you tell the court of your
observations on the day in question?
Floria Tenne:
In regards to 'Commander Dorat'?
Nico Viechamalli:
*nods*
If you please.
Floria Tenne:
Well I was amist the attacks at the South gate with many others..
Taggart:
your Honour?
Floria Tenne:
Doing what I do best... observing whilst lending a hand with fighting off the attacks..
Irvyn:
Do you have an objection, Taggart?
Floria Tenne:
I noticed a gathering of Civillians on the roof of the building bes-
Taggart:
never mind
Floria Tenne:
.. do I continue?
Alright..
Nico Viechamalli:
Yes, please do.
Floria Tenne:
The building beside south gate
Nico Viechamalli:
*nods encouragingly*
Floria Tenne:
I ventured up there, in the hope of calming them down and ushering them to safety
When I arrived at the top of the building "Commander" Dorat was there
Amongst them, and wash herding them into one of those blue portals.
Shouting at them.
Nico Viechamalli:
Did they go willingly?
Floria Tenne:
He appeared to be using force
Nico Viechamalli:
*nods*
And were these soldiers or civilians?
Floria Tenne:
Civilians
Trinsicans I'd say from their attire and accents.
Larynda:
*Shakes her head accusingly at Dorat*
Nico Viechamalli:
A most concise description, thankyou.
Larynda:
Tsk..
Nico Viechamalli:
Mr Taggart, do you have any questions
for my witness?
Taggart:
just one
Nico Viechamalli:
*enquiring look*
Taggart:
did you see me Dorat harm the civillans?
Floria Tenne:
He was shouting and demanding they enter the gate. Whilst wearing armour and appearing threatenin
So I guess it depends on your opinion of the word harming.
Hebrind Kelter:
*smirks*
Irvyn:
*rubs chin*
Hebrind Kelter:
I suppose that is your definition of "Force"...?
Floria Tenne:
Physically, no. Mentally? Emotionally? Yes.
You can foce someone to do something in many ways.
Hebrind Kelter:
Indeed. So... He had no accomplises?
Floria Tenne:
And I believe Lord Taggart is the prosecution. So take your seat as requested by the judge?
*Looks to Taggart*
Chaismene Volte:
*smirks*
Irvyn:
Defense counsel.
*smiles*
Hebrind Kelter:
Or I could stand here like I did yesterday and help second-chair... Maa'm.
Gwen Irima:
*mutter* should have come in time then...
Taggart:
but he could of been moving them for their own safety
Hebrind Kelter:
Very well.
*bow*
Iljian:
Thafety in a dark dungeon? *mutters*
Floria Tenne:
The civillians ended up in a dungeon, with worse things than what was in Trinsic
Irvyn:
*nods*
Floria Tenne:
and without the safety of guards. That's not for their safety.
*Looks around*
Taggart:
no more questions
Irvyn:
*nods to Floria*
Nico Viechamalli:
Thank you Miss Floria.
*smiles*
Perhaps I might now speak with Mr Dorat?
Dorat Royal Guard Commander:
*Looks at Irvyn*
Irvyn:
*nods*
Please take the floor again.
Nico Viechamalli:
*smiles to him with a hint of shark*
Flame:
*looks at Dorat*
Nico Viechamalli:
Mr Dorat, I believe you admitted to leading the army
against Trinsic on 28th June?
Dorat Royal Guard Commander:
*Nods*
I did
Nico Viechamalli:
The balrons, and the brigands - you commanded them/
?
Gwen Irima:
*listens intently*
Dorat Royal Guard Commander:
No, the Daemons were commanded by The Beast
Alexander Fraser:
His confederate
Nico Viechamalli:
But it was a coordinated attack?
Alexander Fraser:
*Nods*
Dorat Royal Guard Commander:
*Nods*
It was
As ordered by Lord Casca
Nico Viechamalli:
So there must have been some plotting going on.
Where is the proof that it was ordered by Casca?
*innocently enquiring expression*
Dorat Royal Guard Commander:
Lord Casca is the King sir. All large militairy actions are ordered by him
Chaismene Volte:
*shuffles slightly*
Nico Viechamalli:
That is not proof, only speculation.
Flame:
*looks top Irvyn*
Irvyn:
*small smile*
Alexander Fraser:
*Mutters "What sort o' man consorts wi' demons?*
Flame:
may I ask a question
Dorat Royal Guard Commander:
If you would permit me to return to the castle I could present you with written orders
Nico Viechamalli:
Do you have written orders, protocols, rules?
I see ... and yet in the note found
outside the gate discussing the attack
there is no indication that Casca was even aware of it.
Dorat Royal Guard Commander:
He is the King! Of course he is aware....
Nico Viechamalli:
*birdlike tilt of head*
So he is ordering demons to attack his citizens?
Taggart:
Object
objection
Nico Viechamalli:
*looks at the Duke*
Taggart:
Conclusion
Irvyn:
Yes, Taggart?
Nico Viechamalli:
A reasonable one - since Mr Dorat says Casca orders everything
and ordered this attack on Trinsic
which was coordinated with demons.
Irvyn:
*nods a little*
A valid point ... it is effectively what Dorat just said.
Nico Viechamalli:
*looks back at Dorat*
To the matter of the kidnapped citizens then.
Dorat Royal Guard Commander:
*Looks at Irvyn*
Irvyn:
*returns his gaze*
Mr Viechamalli has not concluded everything.
Nico Viechamalli:
This court has heard three witnesses
who described citizens being taken away by you.
With very positive identifications.
Do you admit that you did this?
Dorat Royal Guard Commander:
I do
Nico Viechamalli:
*blinks slowly once, like a lizard*
And were they unwilling to go with you?
Dorat Royal Guard Commander:
They were
Irvyn:
*raises eyebrow*
Nico Viechamalli:
And were they happy to stay where you trapped
*coughs*
took them?
Dorat Royal Guard Commander:
*Raises a brow*
Dorat Royal Guard Commander:
They were hostages, they weren't supposed to enjoy themselves
Alexander Fraser:
Ah!
Chaismene Volte:
*frowns*
Nico Viechamalli:
I see.
*looks down at notes*
So... you admit that you attacked Trinsic
in alliance with demons
and you kidnapped a group of defenceless citzens
Leo Madsen:
*Leans forward murmuring*
Nico Viechamalli:
and attempted to hold them in a rather unpleasant place?
Dorat Royal Guard Commander:
Those were Lord Casca's orders
Nico Viechamalli:
Alas, I regret that Casca was not present.
It is your actions we are considering.
You led the attack, did you not?
Dorat Royal Guard Commander:
I led my battalions
Flame:
*looks slightly confused*
Nico Viechamalli:
Ah yes, the ragged unarmored brigands -
a bit of a come down, was it not?
Dorat Royal Guard Commander:
*Frowns*
Nico Viechamalli:
*apparent sympathy*
Dorat Royal Guard Commander:
Your honour?
Irvyn:
Yes, Dorat?
Taggart:
objection Assumption of Facts that they where brigands
Dorat Royal Guard Commander:
I object to the prosecutions last comment
Nico Viechamalli:
*dry smile*
They were described as such, but I will withdraw.
Irvyn:
Very well, let the ojection stand.
Reann:
*mutters if they were soldiers britannia is doomed...*
Nico Viechamalli:
They were not your normal troops, were they?
Alyona Karalova:
*Folds arms, leaning back against the wall*
Dorat Royal Guard Commander:
Soldiers come and go. That's the nature of the profession
Nico Viechamalli:
You stayed for 14 years.
Are you so unusual?
*birdlike tilt of head*
Dorat Royal Guard Commander:
*Puffs chest*
I am not a soldiers
Duncan McKinley:
*salutes his officier*
Nico Viechamalli:
Are you not?
Duncan McKinley:
Sanctum Viatas - Sacred Journey
Dorat Royal Guard Commander:
*Taps his foot impatiently*
I am the commander!
Nico Viechamalli:
And I am sure you have been a good one.
Do you look after your troops?
Taggart:
objection Irrelevant
Irvyn:
*rubs chin*
Nico Viechamalli:
*looks at the Duke*
Irvyn:
What is the objection?
Taggart:
how the troops are treated
what does it have to do with any of the charges
Nico Viechamalli:
It is relevant to Mr Dorat being a commander.
Leo Madsen:
He's establishing what kind of man and officer Dorat is.
Irvyn:
*considers*
Agreed ... objection overruled.
Nico Viechamalli:
Thank you your Grace.
Leo Madsen:
*Rolls eyes*
Alexander Fraser:
I wonder if he treats the balrons well....
Dorat Royal Guard Commander:
*Sighs*
Nico Viechamalli:
*looks back at Dorat*
Sparrow:
*who cares*
Leo Madsen:
Feeds them plenty of citizens I guess.
Nico Viechamalli:
Do you look after your troops?
Bladius Dart:
Heh.
Dorat Royal Guard Commander:
Not individually. That is their respective luitenants task
Nico Viechamalli:
*nods*
But overall, you have responsibility for them?
Dorat Royal Guard Commander:
I am their commander...
So yes
Nico Viechamalli:
*nods*
So you ordered them to attack Trinsic
in company with demons
but did not give them any armour or decent weapons?
Dorat Royal Guard Commander:
The troops that attack trinsic were mostly new recruits
They have to prove their worth before we issue them expensive armour
Nico Viechamalli:
*scratches cheek*
Irvyn:
*raises eyebrow*
Alexander Fraser:
*Nods*
Iljian:
*frowns deeply*
Gwen Irima:
*blinks*

Haphazard Scrawl - Duke's Clerk
__________________________________________________

Nico Viechamalli:
So you sent raw recruits against the most heavily
fortified city in the whole of Britannia?
Dorat Royal Guard Commander:
I was ordered to do so
Nico Viechamalli:
I fear your claim to be a good commander
really does not add up.
Sparrow:
*falls asleep*
Nico Viechamalli:
But as you have admitted to attacking, kidnapping,
and unlawful imprisonment
Taggart:
objection
Assumption of Facts
Nico Viechamalli:
*stops and looks at Taggart*
Taggart:
as it unlaw imprisonment
Irvyn:
He did admit to leading the attack, and to taking the citizens and imprisoning them.
Taggart:
but never that it was illegal
Nico Viechamalli:
*nods*
Dorat Royal Guard Commander:
*Nods*
Nico Viechamalli:
Oh? And how so?
Dorat Royal Guard Commander:
The citizens of Trinsic openly defied Lord Casca
Alexander Fraser:
*norts*
Dorat Royal Guard Commander:
An act of treason against the crown
Alexander Fraser:
*Snorts too*
Leo Madsen:
A crown that wasnt his to begin with.
Nico Viechamalli:
But that is not at issue here.
What is at issue is that you personally led an army here
with the intent to overthrow the Duke
as shown in the note of the conspiracy,
and you took citizens and held them against their will
which is unlawful imprisonment.
Taggart:
objection
Nico Viechamalli:
*tilts head*
Taggart:
Assumption of Facts
that the note was from Dorat
Nico Viechamalli:
Not at all.
*shakes head*
The note merely proves that there was a conspiracy
to attack Trinsic.
Since Dorat freely confesses to leading this attack
he must have been aware of the conspiracy.
In point of fact, it is unlikely that he wrote it.
As it refers to a commanding officer
and he is adamant that this was himself
and the note is not written by the officer.
Irvyn:
*waits politely for a response*
Dorat Royal Guard Commander:
Hm, me?
Irvyn:
It would be good if you could comment on Mr Viechamalli's observsation.
Nico Viechamalli:
*nods with a thin smile*
You were the commanding officer
were you not?
Dorat Royal Guard Commander:
I told you before..
Nico Viechamalli:
Please say it again, just for the record.
*tiny smile at Haphazard*
Dorat Royal Guard Commander:
*sighs*
Haphazard Scrawl:
*dips pen in ink*
Dorat Royal Guard Commander:
I am Dorat, Commander of the Royal Guard
Haphazard Scrawl:
*underlines Commander*
Nico Viechamalli:
Thank you.
I have no further questions.
Dorat Royal Guard Commander:
*nods*
Nico Viechamalli:
*looks at Taggart*
Bladius Dart:
*Murmurs something*
Taggart:
I have no more witnesses
Irvyn:
Taggart, do you wish to make a final brief statement?
Taggart:
I am ready for my closing statement
Irvyn:
*nods*
Taggart:
on the charges of Treason
the prosecution has said very little
I must remind the jury
that treason is comitted agasit the goverment
or a nation
and Trinsic is not a nation it is just a part of the kingdom
and for Dorat to be guilty of treason
Iljian:
*mutters* Maybe read the lawth of Trinthic before going to court?
Taggart:
then it most be proven that Casca is not the King
Tommy Nottinbury:
Heh..
Irvyn:
*rubs chin*
Taggart:
for the kidnapping charge
Irvyn:
You should acquaint yourself with the law a little better.
But please continue.
Taggart:
it would need to be proven that Dorat acted ilegaly
maybe if he was just a brigand he would be
but he is following orders from his king and nation
Alexander Fraser:
Nation?
Leo Madsen:
..Nation? Who bkaced him?
Iljian:
Cathcaland
Leo Madsen:
Other than just Casca.
Taggart:
and as for assult all he did was take part in battle with guards who where trained for it
which is not what assult is about
his action are more akin to pillaging
Leo Madsen:
Lets add theft to his crimes then.
Irvyn:
*rubs chin*
Not at this time.
Reann:
assault on guards is a crime...
Sparrow:
Im not trained his army attacked me
and i dont even live here
Taggart:
so in summary where as Dorat may be guilty of crimes
the ones this court was brought up agasit him he is not guilty of
Nico Viechamalli:
*scribbles a couple of notes and looks over with a benign smile*
Irvyn:
Is your statement complete?
Taggart:
aye
Irvyn:
*nods*
*looks to Nico*
You may proceed, Mr Viechamalli
Nico Viechamalli:
Thank you, your Grace.
*looks around the court*
Your Grace, my lords, ladies and gentlemen.
You have heard from those who saw the defendent
Gwen Irima:
*nods*
Nico Viechamalli:
taking citizens of Trinsic against their will
and using force to do so.
Further he admits imprisoning them unlawfully.
In addition, we have submitted proof to you
that there was a conspiracy to attack Trinsic.
Deliberately aimed at damaging and destabilisng
the Duchy, which is treason under Trinsic law.
The defendent insists that he is the Commander
and is responsible for his troops.
To attack any citizen of Trinsic is assault
again under Trinsic law.
It is his actions
for which he is on trial today
and I submit to the court
that by his own mouth he stands condemned.
*bows slightly*
Flame:
*looks at Dorat*
Chaismene Volte:
*nods*
Irvyn:
You are completed.
Nico Viechamalli:
I am, your Grace.
Irvyn:
Very well.
*looks to the jury*
Ladies and gentlemen
I must now ask you to consider the evidence presented.
Mr Scrawl's notes will, I hope, be made available to you.
*looks questioningly at Haphazard*
You may take time to consult over the next three days
Haphazard Scrawl:
Your Grace, I will be publishing them in copies to each juror shortly
Irvyn:
*nods*
and on the fourth day, which is Sunday 19th July
Haphazard Scrawl:
As soon as I can transcribe them
Irvyn:
we will reconvene to hear your verdict.
Billy:
*cleans glasses*

Haphazard Scrawl:

Again I watched the trial with interest and tried in my own mind to think of routes for both the prosecution and defence of Dorat.

For the Defence I was unable to come up with any good lines to follow and I think counsel did extremely well under the circumstances. He took the only courses of action open to him as far as i could see.

The Prosecution had a far easier task and with the Defendant largely admitting accountability for the charges against him had really only to press home his advantage.

One major aspect was however overlooked completely by the Prosecution, INTENT.

In law, intent to commit a crime is in itself a crime, thus even when no murder has taken place you can be charged with 'Attempted Murder'.

Consider the 2 charges against Dorat. He admitted leading the attack on Trinsic so what was his intent?.

The subjugation of the City by force and the removal of the Duke as ruler. The attack was repelled but consider what would have happened if successful, the army would have been slaughtered, civilians killed and the City laid waste. This was the INTENT of the attack, the fact it did not happen is due to the valour of the defending forces. Dorat admits leading this attack.

As to the demons enlisted by the 'King' to join in this attack, Dorat denies leading them but they were a part of the attacking forces for which he holds the responsibilty. What inducement was offered by the 'King for their involvement?. What reward for them?. It certainly wont have been pie and chips at the local hostelry. Whatever it was will not have been pleasant for Trinsic or its citizenry or indeed the Duke, perhaps they are partial to barbecued Duke?.

And now the 2nd charge the abduction of Trinsicians, much was made of their condition and how Dorat treated them but NOTHING of the INTENT.

What is the purpose of hostages? To induce some action by blackmail. In this case because they were released we shall never know the reason but it is reasonable to assume their purpose was to force some action by Trinsic or its ruler to submit to the 'King's demands.

It is probable that these innocent residents would have been executed should the blackmail demands be refused as they would then have become useless to their captors.

There is one other possibilty for them being taken but I hesitate to put this into words the prospect is so horrible. Just maybe they were to be the demons rewards?.

As I said we shall never know as they were fortunately released before either fate overtook them, but whatever the reason it was not for either theirs or Trinsics health.

For the attention of Bobar

Dear Sir,

I must thank you for another very cogent analysis of Dorat's trial. You are right, there were many avenues we could have explored, but time, alas, was short. Perhaps, if Dorat is feeling better inclined to answer questions, we will try asking more of him on Sunday. Casca's motives do indeed worry me.

Thank you also for your book "Went the day well?" I have put a copy on the table in the Records Office outside Trinsic, so that others may read it. It may be a work of fiction, but it describes the day to perfection.
