How does one burn counts through no fault of his own one of my char is red now (really he did nothing wrong nothing) does he just stand in moongate and stay logged in ??

Not sure how you "accidentally" become red but the only way is to stay logged in for 40 hours for each murder count you need to remove
Yep. If you stand in Yew gate or somewhere busy where people are constantly on your screen, it'll keep you logged in for as long as you need.

one more stupid question
after 40 hours when my first count is gone and i am left with just 4 i am no longer red ? or do i have to burn off all 5 counts to go blue ?

Just have to lose the 1. You go red on 5th count.

I am accidentaly burning counts. Nobody counts me anymore.
