Basically, the contract companies agree with Kickstarter for them hosting their project is a legal and binding contract. If the project gets funded, the company posting it is legally obligated to either supply the promised content or refund the pledged monies. In this case, Altius failed on both accounts and therefore is being sued by Washington State Attorney General for refunds and punitive damages...totaling over $1million USD.
Some of the articles on this event note that other kickstarter scams have been sued...and lost...and had to refund $$$ to the backers.
